Transnational temporary employee secondment operations and service rendering activities within European territory by member state companies are authorised under Community law and shall be complemented by the specific legislation of each country.

DIRECTIVE 96/71/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 December 1996 concerning the posting of workers in the framework of the provision of services.

DIRECTIVE 2008/104/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 19 November 2008 on temporary agency work

 

Directive 96/71/EC

Directive 96/71/EC refers to the posting of workers within EU territory in the context of the rendering of services.
It applies to companies based in a Member state which, in the context of a transnational provision of services, post workers to the territory of some other Member State.
Thus directive authorises and regulates, amongst other considerations, the posting of a worker to a user company established in the territory of a Member State or which carries out activity therein in the capacity of a temporary work company or a company which makes a worker available.

Directive 2008/104/EC

The purpose of this Directive is to ensure the protection of temporary agency workers and to improve the quality of temporary agency work by ensuring that the principle of equal treatment, as set out in Article 5, is applied to temporary agency workers, and by recognising temporarywork agencies as employers, while taking into account the need to establish a suitable framework for the use of temporary agency work with a view to contributing effectively to the creation of jobs and to the development of flexible forms of working.
